Kompetenzen:	In this lecture students get to-depth knowledge of the theorie and methods of Labor and Employment Law in the U.S.A. The Course enable students to perceive tax problems at an international level, to analyze them and to devolop appropriate solutions.
Inhalte/Themen:	Although frequently portrayed as the land of "hire and fire", the actual situation in the U.S. presents a rather more complicated picture. This module will provide a comprehensive introduction to and overview of the employment-ordering regime int the United States. To do this, the module will investigate the key characteristics of the National Labor Relations Act, the Nation's Basic labor relations law, including the central features of Americcan collective bargaining and the protection the NLRA extends to non-unionized workers. it then wll turn to a consideration of individual employment law, considering among other matters, the rise and the qualification ot the employmet at will rule and the extent of common law protections of individual autonoiy. Some overview of the Amercan minimal wage law and workplace safety laws sill be proveded. The rise of the use of mandatory arbitration as a substitute to common law courts for the vindication of employment rights will be considered. The module also will investigate American anti-discrimination law, with a special emphasis on the impact of Titel VII of the Civil Rights Act of 1964. No previous background is necessary or expected. Constant reference will be had to comparative considerations of American with German and European law. Presentations will be framed with reference to the history of legal developments., the philosophical tedencies that direct Amerca developments ad attitudes and the influence of religious thought in the ordering regime.The American System of federalism and its impact on employment ordering will be part of the discussion. Current trends in the law and the future of work will be discussed. Reading will be assigned from materials available on library reserve.
